Terms of Service

Please read these Terms of Service carefully before using the TradeBound mobile application and related services. By creating an account or using TradeBound, you agree to be bound by these Terms. If you do not agree, do not use TradeBound.

1. Acceptance of Terms

These Terms of Service govern your use of the TradeBound mobile application, website, and all related services (collectively, the “Service”) operated by TradeBound LLC (“TradeBound,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.

We reserve the right to update or modify these Terms at any time. We will notify you of material changes by updating the date at the top of this page and, where appropriate, through in-app notifications. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 18 years of age to create an account or use TradeBound. By using the Service, you represent and warrant that you are at least 18 years old. We reserve the right to terminate accounts of users who do not meet this requirement.

3. Account Registration

To use TradeBound, you must create an account by providing a valid email address, creating a password, and verifying your phone number via SMS. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account
• Use your real identity and represent yourself honestly
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account

You may not create multiple accounts. You may not create an account on behalf of another person without their permission. To protect the integrity of user reputations, changes to your display name and profile photo may be limited in frequency.

Your display name must be your actual first name. Storefront or vendor alias accounts — for example, a name like “TCG_Vault_208” instead of a person — are not permitted unless the account is a verified shop operating under its real business name. Accounts using alias names may be renamed, suspended, or terminated.

4. The Service

TradeBound is a local marketplace platform that connects trading card buyers, sellers, and traders in their geographic area. TradeBound provides the platform for users to discover, list, and communicate about trading cards and related items. TradeBound does not participate in, facilitate, or process transactions between users.

TradeBound is a venue only. We are not a party to any transaction between users. We do not inspect, verify, authenticate, or guarantee any items listed on the platform. We do not process payments, hold funds, or provide escrow services. All transactions are conducted in person between users at their own discretion and risk.

5. Permitted Items

TradeBound is a marketplace exclusively for trading cards and related accessories. The following items are permitted:

• Trading cards (Pokémon, Magic: The Gathering, One Piece, Yu-Gi-Oh!, Lorcana, Sports cards, and other trading card games)
• Sealed trading card product (booster boxes, packs, elite trainer boxes, collection boxes)
• Card accessories (sleeves, toploaders, deck boxes, binders, playmats)
• Custom card binders and storage solutions

Any items not listed above are prohibited and may be removed at our discretion. We reserve the right to remove any listing for any reason.

6. Listing Rules

When creating a listing, you agree to the following:

• All photos must be real photographs of the actual item you are selling or trading. AI-generated images, stock photos, screenshots from other listings, and misleading images are strictly prohibited.
• Listing descriptions must accurately represent the item, including its condition
• Prices and trade values must be stated clearly and honestly
• You must have the item in your possession and available for immediate exchange
• Listings expire after 30 days and must be relisted if still available
• Duplicate or spam listings are prohibited

Violation of these rules may result in listing removal, account warning, or account termination.

7. User Conduct

You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable law
• Harass, threaten, intimidate, or abuse other users
• Post false, misleading, or deceptive content
• Impersonate any person or entity
• Manipulate the rating system through fake transactions, fake accounts, or coordinated rating schemes
• Solicit users to complete transactions outside of TradeBound to avoid the rating system
• Use automated tools, bots, or scripts to access the Service
• Collect personal information about other users
• Interfere with or disrupt the Service or its infrastructure
• Post content that is obscene, hateful, discriminatory, or promotes violence

8. In-Person Meetups and Safety

TradeBound is designed for local, in-person transactions. We provide a curated list of safe meetup spots including local game stores, police stations, public parks, and other public locations. We strongly recommend that all transactions take place at these suggested locations.

TradeBound does not guarantee your safety. While we provide safe meetup spot recommendations, we are not responsible for any incidents, injuries, losses, damages, or disputes that occur during in-person meetups. Users meet at their own risk.

We do not offer shipping services. TradeBound is not a shipping marketplace. Any arrangements to ship items are made entirely outside of TradeBound and at the users’ own risk.

9. Ratings, Reviews, and Deal Reports

After completing a transaction, both parties may rate each other on a scale of 1 to 5 stars with an optional written comment. By using the rating system, you agree to:

• Provide honest and accurate feedback based on your actual experience
• Not submit fraudulent, retaliatory, or coordinated ratings
• Not offer or accept compensation in exchange for ratings

Ratings are earned through completed deals and cannot be purchased. The “Mark as Complete” feature becomes available once both parties have sent messages in a conversation. You may only rate the same person once every 7 days.

If the other party fails to show up for an agreed meetup, you may report the deal as not having happened. The reported user is notified of the report, and you may withdraw a report within 7 days of filing it. False reports are reviewed and may result in action against the reporting account.

TradeBound reserves the right to remove ratings that violate these Terms or that we believe to be fraudulent.

10. Messaging

TradeBound provides in-app messaging for users to communicate about listings. You may share text messages and photos of cards within conversations. By using messaging, you agree to:

• Not send spam, unsolicited advertisements, or promotional content
• Not share another user’s personal information without their consent
• Not send threatening, harassing, or abusive messages
• Not send explicit, obscene, or inappropriate content

Photo sharing in conversations is limited to 5 photos per conversation per hour. All photos uploaded to TradeBound are automatically compressed and have location metadata (EXIF data) removed for privacy and safety.

Messages are private between conversation participants. If you report another user — including by long-pressing a photo they sent you — the relevant conversation may be reviewed to enforce these Terms.

11. Paid Features

TradeBound is currently free to use. We may introduce optional paid features in the future, such as promoted listings or event banners for local game stores. If we do, pricing will be clearly disclosed before any purchase, promoted content will be clearly labeled to distinguish it from organic content, and this section will be updated. Any paid features will be non-refundable unless required by applicable law.

12. Intellectual Property

The TradeBound name, logo, design, and all associated trademarks, graphics, and software are the property of TradeBound and are protected by intellectual property laws. You may not use, reproduce, or distribute any TradeBound branding without our prior written consent.

By posting content on TradeBound (including photos, descriptions, and reviews), you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content solely in connection with operating and promoting the Service. You retain ownership of your content. This license ends when you delete your content or your account, except where your content has been shared with others and they have not deleted it.

13. Content Removal and Account Termination

TradeBound reserves the right, at its sole discretion, to:

• Remove any listing, message, rating, or other content that violates these Terms or that we deem inappropriate
• Issue warnings to users who violate these Terms
• Temporarily suspend or permanently terminate any user account
• Restrict access to any or all features of the Service

Reports from users are reviewed manually. We will make reasonable efforts to notify users of account actions, but are not obligated to do so.

14. Reporting and Moderation

Users may report listings, messages, or other users that they believe violate these Terms. We review reports and take appropriate action, which may include content removal, warnings, or account termination.

Users who submit false or malicious reports may themselves be subject to warnings or account termination.

TradeBound does not mediate disputes between users regarding the quality, authenticity, value, or fairness of transactions. Disputes between users are the sole responsibility of the parties involved.

15. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not warrant the accuracy, completeness, or reliability of any content posted by users.

TradeBound does not verify the identity of users beyond email and phone verification. We do not verify, authenticate, or guarantee the authenticity, condition, or value of any items listed on the platform. Users are solely responsible for inspecting items before completing a transaction.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TRADEBOUND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

TRADEBOUND IS NOT LIABLE FOR ANY DAMAGES, LOSSES, INJURIES, OR HARM ARISING FROM TRANSACTIONS OR INTERACTIONS BETWEEN USERS, INCLUDING BUT NOT LIMITED TO IN-PERSON MEETUPS, DISPUTES OVER ITEM QUALITY OR AUTHENTICITY, OR FAILURE OF USERS TO COMPLETE TRANSACTIONS.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID TO TRADEBOUND IN THE 12 MONTHS PRECEDING THE CLAIM.

17. Indemnification

You agree to indemnify, defend, and hold harmless TradeBound and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.

18. Dispute Resolution and Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association. Arbitration shall take place in Ada County, Idaho.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not in a class, consolidated, or representative action. You waive your right to participate in a class action lawsuit or class-wide arbitration.

You may opt out of this arbitration provision by sending written notice to tradeboundapp@gmail.com within 30 days of creating your account. If you opt out, disputes will be resolved in the state or federal courts located in Ada County, Idaho.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Idaho, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought in the state or federal courts located in Ada County, Idaho.
